U.S. Naturals Independent Member Policies and Procedures

Any Independent Member:

  1. Must be of legal age of consent, or a business or a registered company entity correctly established in the state/area in which they reside.
  2. Has completed an online U.S. Naturals Independent Member Application and Agreement Form (in English).
  3. Has read and will familiarise themselves with all of the Policies & Procedures, Code of Ethics and Compensation Plan of U.S. Naturals as contained on the Head Office Web Site at www.USNaturals.net
  4. May not be employed either directly or indirectly by U.S. Naturals Inc., or be an immediate family member residing with an employee of the company for whatever reason.

To Become an Independent Member

Application may be made only via the U.S. Naturals website at www.USNaturals.net Applications are also permitted by authorised person(s) of the Applicant, where the authorised person(s) is in possession of such instruction. It is highly recommended that any new U.S. Naturals Member immediately familiarise themselves with the product information contained online if they are not already a consumer, however, it is not compulsory. U.S. Naturals has the right to review and approve or disapprove any or all applications within 28 days from the time they are submitted.

Independent Members Commission Payment Method

All commission, bonuses, and any other payments owed to the U.S. Naturals Member will be paid directly onto the U.S. Naturals Member’s Stored Value Card.

Independent Members Stored Value Card

Stored Value Cards are covered under separate Policies and Procedures. You will agree to read and abide by these Policies and Procedures as set out by the Stored Value Card provider. These Policies and Procedures will be included with the delivery of your Stored Value Card. Any misuse, misrepresentation or activity that is deemed to represent a breach of these Policies and Procedures will result in the Membership being terminated along with the Stored Value Card being cancelled. U.S. Naturals reserves the right to cancel any Stored Value Card at any time where sufficient evidence has been provided to identify that a breach of the Policies and Procedures has or will take place.

Stored Value Card Promotion

It is forbidden for a Member to promote U.S. Naturals on the basis of just the Stored Value Card. The U.S. Naturals Stored Value Card can itself be promoted together with the products of the Company. All promotional material must be approved by an Authorised Officer of the Company.

Independent Members and the Law

A U.S. Naturals Member may not make any medical claim for any U.S. Naturals product, whether expressed or implied.

A U.S. Naturals Member is not permitted to diagnose any medical, health, skin or any other such condition or prescribe any product as a specific treatment for any disease, illness and/or condition. The law does not permit specific medical claims or purported cures. The Government has put this legislation in place to protect the public from those who could deliberately suggest, claim or infer that any such substance would replace the need for current established professional, medical or diagnostic advice or treatment.

Experience from use of U.S. Naturals products provides any individual an opportunity to reach a personal conclusion without influence or inducement by a third party. A U.S. Naturals Member may provide current company or manufacturers literature (where approved by U.S. Naturals) and may speak of his/her own personal experience(s) with the products. U.S. Naturals Members have no authority whatsoever to commit U.S. Naturals to any obligation irrespective of its nature. Each U.S. Naturals Member shall hold U.S. Naturals harmless from any claim, damages, or liability arising out of a U.S. Naturals Member’s business or advertising. Any U.S. Naturals Member making illegal and or unapproved claims about U.S. Naturals or its products should be aware that their Membership shall be terminated and that they may also leave themselves open to prosecution. In such extremity U.S. Naturals Corporate would advise the U.S. Naturals Member to seek independent, professional advice. If a U.S. Naturals Member fails to comply with established policies and procedures, laws or court orders, U.S. Naturals will have no choice but to terminate their Membership.

Product Liability

U.S. Naturals does not cover any harm or cost which may result from any form of misrepresentation or misinformation given to anyone by the U.S. Naturals Member.

Advertising & Promotional Material – Company Approval Required

All advertising, including but not limited to flyers, press releases and statements made on telephone answering machines, voicemail systems or prepared for publication in any advertising medium using company names, trademarks or logos, must be approved by an Authorised Officer of the Company in writing prior to publication. If any promotional material is approved for one U.S. Naturals Member, provided that it remains unaltered in its approved state then it will not need subsequent approval for any further U.S. Naturals Member wishing to use the same. Please ensure that all Members in your downline are aware that failure to receive approval for any promotional material may result in termination of their Membership.

U.S. Naturals Members are fully responsible for all verbal and written statements regarding the product and marketing program that are not contained in any printed form advertising or promotional materials supplied directly by the Company either in hard copy or via the U.S. Naturals internet site. All U.S. Naturals Members agree to indemnify U.S. Naturals and hold it harmless from any and all liability including judgments, civil penalties, refunds, attorney fees, court costs or lost business incurred by U.S. Naturals as a result of any advertising or any unauthorized representations made by any U.S. Naturals Member.

U.S. Naturals Members are free to sell products for whatever price they choose, but must be aware that any significant increase or decrease that will form part of any promotional campaign may result in the promotional literature not being approved.  U.S. Naturals retail price recommendations will be found on the U.S. Naturals web site.

Answering Machines and Telephone Answering Services

U.S. Naturals Members may not mislead any callers to think that they are calling any U.S. Naturals Corporate Office. Any person answering the telephone in this way is in breach of U.S. Naturals Policies and Procedures.

Use of U.S. Naturals Name and Copyrighted Materials

The names U.S. Naturals and Sizzling Minerals are used to identify the Company, its products, sales and marketing programs and to distinguish them from any other product and program offered to the public. The names U.S. Naturals, Sizzling Minerals and other names, logos or marks as may be adopted and used by the company are proprietary and have great commercial and intrinsic value to the company as distinguishing marks and symbols. Whenever promoted or used in an unauthorized manner, the inherent value and effectiveness of the name is lessened, weakened or in extreme cases damaged. Therefore, it is in the interest of Company and the Members to make every effort to protect its names, products and marketing program. Any unauthorized use will result in the immediate termination of the Membership. Therefore, in order to protect its proprietary rights, the Company requires that its Members comply with the following rules and regulations:

  1. U.S. Naturals will not permit the use of its copyrights, designs, logos, trade names, trademarks, etc., without prior written permission.
     
  2. All U.S. Naturals materials, whether printed, in computer format or produced by sound and or video recording are copyrighted and may NOT be reproduced in whole or in part by any U.S. Naturals Member or any other person except as authorized by the Company. Permission to reproduce any materials will be considered only in extreme circumstances.
     
  3. A U.S. Naturals Member may not produce, sell or distribute any materials relative to any potential hypothetical examples relative to earning potential. Any hypothetical examples must be accompanied by a statement that typical or individual earnings of Members are reliant upon individual efforts, geographical location, timing, and many other factors beyond the control of the company.
     
  4. A U.S. Naturals Member may not purchase, sell or distribute non-company materials which imply or suggest that said materials originate from the Company.
     
  5. A U.S. Naturals Membership shall not at any time use the U.S. Naturals or Sizzling Minerals name or any of its trademarks as part of its own Membership name, website, email address, or imply in any other way that it is an agent or employee of the company.
     
  6. The ONLY authorized use of the U.S. Naturals name by a Member is in identifying him/herself as an INDEPENDENT MEMBER. All business cards, signs and advertising materials, etc., utilized by a Member must identify the Member clearly as an Independent Member of U.S. Naturals Inc.

Trade, Conventions and Mall Shows

U.S. Naturals Members can participate in and sell product at conventions, trade and mall shows. U.S. Naturals do not encourage that products be sold within a retail environment. Prior approval must be given in writing from U.S. Naturals Corporate before any retail outlet sales may take place. U.S. Naturals will terminate the Membership of any Member who fails to comply with this policy.

Freight Subsidy

U.S. Naturals has subsidized the freight (usually by Air) of most packages and shipments by 50% and in the case of certain products sold by package and or promotional package by 80% or more. U.S. Naturals retains the right to change this policy at any time.

Defective Product

If a product is defective, the consumer must notify the Member in writing within 10 days of purchase. Each Member is expected to honour the Customer Refund Policy in a prompt and courteous manner and should refund the full purchase price. Within 14 days of reimbursement to the customer, the Member must contact U.S. Naturals and request a Return Number. The defective product must be sent to the Company Returns Address in a package clearly marked on the outside with the Return Number within 28 days from the time the order was placed. All defective products will then be promptly replaced at no charge. Product not returned within 28 days is considered dated and cannot be returned.

Damaged Product

Should any shipment arrive in less than satisfactory condition, make the person who delivered the goods aware and then call the carrier immediately to advise or refuse the shipment. It is the responsibility of the Member to verify the condition of each shipment upon receipt.

Cancellation - Involuntary

The company reserves the right to terminate any Membership at any time for breach of any municipal, state or federal laws or regulations, the Member Agreement, the Code of Ethics or these Policies & Procedures as they may be amended from time to time.

Cancellation - Voluntary

Each U.S. Naturals Member has the right to cancel their Membership for any reason and at any time. The Member must notify the Company of the intention to cancel, in writing. A U.S. Naturals Customer Service representative will contact the Member and provide all necessary information with respect to cancellation. The Company will honour refund policies provided by any state or federal law applicable to the Member. A Member may at any time exchange product purchased within 30 days of the return, provided it is returned in unused, resalable condition. If a Membership is cancelled within five days following execution of the Membership Agreement, refunds will be made in full for all products, Member Kits and sales aids returned in resalable condition.

Refund of Product

In any case of product being returned for a refund either due to involuntary or voluntary cancellation the refund will be less any commissions that may have already been paid. It is the Members responsibility to cover all costs of freight, duty and or any such charges relating to any return.

Stock and The 80% Rule

By placing an order, a Member certifies on each and every product order placed through U.S. Naturals that at least 80% of all products previously purchased have been sold. For the purposes of this rule a sale may include a purchase for family or personal use.

All U.S. Naturals Members agree that they will not purchase stock either directly or indirectly to advance their Membership within the U.S. Naturals Member Network. Any such activity will result in termination of the Membership(s) involved.

Price Changes

All U.S. Naturals products and literature prices are subject to change. Any change will be announced through the Company web site at www.USNaturals.net

Training Requirement

A Member who sponsors a Member is required to ensure that the new Member is properly trained in respect to Policies and Procedures and Code of Ethics.

Downline Communications

Members are encouraged to promote information to their respective downlines. The proper use of internal newsletters, e-mails, training aids and other organizational programs are encouraged. However, every Member must exercise the utmost care to avoid giving the impression that they are acting as an agent for U.S. Naturals. The independent status of the Member must be maintained and clearly represented at all times and the Code of Ethics and Policies and Procedures followed.

Compliance

U.S. Naturals do not impose any restrictions on Members joining other Network, Referral or Affiliate Marketing Programmes unless there is a direct conflict of interest in any product range(s).

U.S. Naturals will terminate any Member found actively marketing any other Network, Referral or Affiliate Marketing Programme to any U.S. Naturals Members and or other products that are deemed to be a conflict of interest.

U.S. Naturals imposes such conditions to ensure the integrity of all Memberships throughout its world wide Member network.

Changes in Policies & Procedures

U.S. Naturals reserves the right to make any changes deemed necessary for the success and well-being of the Company and of the Independent Members. These changes may be made without prior approval or agreement of the Members. Any such changes will become an amendment to the agreement between U.S. Naturals and the Member and shall be effective concurrent with the date of notification to Members. All Members will be promptly notified of any such changes in the most expeditious and cost-effective manner.

Policies and Procedures for International Sponsors

U.S. Naturals Inc. offers you the exciting opportunity to expand your network around the world!

Foreign Members require additional support and training from their International sponsor to ensure their success. This support is more challenging than working in your home country because of time, geographic, language & cultural differences.

  1. Any Member may become an International Sponsor. All Foreign volumes count toward rank and income qualification in your home country.
     
  2. Members are automatically able to become International Sponsors upon their initial Member Application being accepted by U.S. Naturals.
     
  3. Information on U.S. Naturals Corporate Offices in the country which you desire to be a sponsor may be found at www.USNaturals.net  this information is subject to update as more Corporate Offices are established.
     
  4. Your new Member should review the U.S. Naturals Web Site to gain further information on any additional, prevailing Polices and Procedures for their country. Requirements and local rules vary so please be advised to seek any guidance or knowledge that may be necessary. International Sponsors are subject to the Policies and Procedures of the individual markets that they are sponsoring in where applicable.
     
  5. All International activity, irrespective of country, will be paid in USD$ directly onto the Members Exclusive U.S. Naturals Stored Value Payment Card.
     
  6. The Sponsor’s foreign downline will produce volumes according to the local market. All volumes whether home or foreign are therefore without loss or penalty to the Member and will be paid in full.
     
  7. Being an International Sponsor means you will be running an international business. You may have increased business expenses to maintain contacts with your foreign downlines. Foreign markets have different taxation, regulations and requirements for doing business. It is your responsibility to find out if you are responsible for any taxation in the country of sponsorship. We recommend you contact your Financial Advisor for further details.
     
  8. U.S. Naturals are able to market seamlessly worldwide. In time we shall introduce Polices and Procedures that will incorporate our Worldwide Marketing Strategy. Please review these updated rules once announced on our web site.
